The Divorce Petition is issued by the Petitioner and has to establish the marriage has irretrievably broken down. It can do so in one of five ways: adultery by the respondent; unreasonable behaviour; desertion by the respondent for 2 years or more; separation for 2 years (if the parties agree); or separation (if there is no agreement) for 5 years.
