Divorce will involve me in severe financial hardship: can I oppose on those grounds?

by Conrad Murray last modified 2007-04-07 12:02

My wife wants a divorce but she already has the house. I have very little money after the mortgage is paid on that house and the rent on my flat, plus very meagre living expenses etc and I know I won't be able to pay for the child support. Can I oppose a divorce on these grounds?

In a case of a Petition being based on five years' separation you may be able to oppose the granting of a decree on the basis that to grant a decree would result in grave financial hardship and that to grant a decree would be wrong in all the circumstances. Although I would need more details at first glance I am not certain the circumstances you describe fit this criteria. I would suggest you need detailed financial advice it may even be your legal advisor can help you achieve a better financial position  than you are in currently after divorce.
