I reached a settlement with my ex-husband but did not tell him I had remarried at the time: can he appeal against the Order?

I was divorced in 1999 and remarried soon after but did not tell anyone. The court order for division of assets did not complete until 2001 and my ex husband remarried in 2002. I received a modest sum in lieu of my husband's pension. My ex husband has now declared he is aware that I had remarried before the settlement was reached and the order made for division of assets. Where does this leave me? Can he appeal against the Order of 2001?

Your ex-husband could apply to the court to vary the final order only if you deliberately misled him about your financial circumstances at the time and that deception made a material difference to the way in which the matrimonial assets were divided.

If you do receive such an application you will need to come back to us for detailed legal advice as this will require a detailed examination of the circumstances.
