I wish to end my 38 year marriage on the grounds of irretrievable breakdown, my husband will not contest my application. Could you inform me how long it will take and how much a solicitor would cost to apply for the divorce and will it be straightforward? For the foreseeable future we would both live in the marital home until we felt the situation was unworkable.
Irretrievable breakdown has to be proved in one of five ways - adultery, unreasonable behaviour, desertion, a period of 2 years separation if both parties consent, a period of 5 years separation regardless of the other party's consent.
How long it would take depends on how co-operative your husband would be and how quickly the Court would process the matter. It should be fairly straightforward if your husband is in agreement.
You can divorce while living under the same roof, but you must live separate lives as far as possible.
