My husband and I have separate bank accounts. If we separated would he be entitled to half of the monies in my account?

My husband and I have separate bank accounts and my wages are paid into mine. Would my husband be entitled to half of the monies in my bank account if we separated with a view to divorce?

Bank accounts are relevant when considering the appropriate division of matrimonial assets but it is not as simple as your husband being entitled to 50%. In order to give comprehensive advice as to the likely outcome, full details of all the assets and circumstances would need to be known. It may be there is no merit in your husband pursuing any money you may have in your sole name, but without all the facts it is impossible to say.

If you are considering divorce but concerned about the best way to proceed and what will happen to the assets and children, we can refer you to a firm of Solicitors who specialise in giving written opinions for a fixed price, setting out the legal position, practical steps you can take and the options available to you, which may help you decide what you wish to do. If you would like us to make this referral please e-mail.
