My partner and I want to separate but if I move out of the house will this affect my rights when we sell the property? The mortgage is in joint names...

My partner and I want to separate. We have a mortgage in both our names and other bills we pay. We also have a daughter. If I move to live with my parents and take my daughter with me on my own free will, will this affect my rights when we sell our property? We are not married but if we can agree on who gets what and how often he sees our daughter, will I still need any additional help?

No, if you move out of your home voluntarily it will not effect your entitlement when you eventually come to sell the property. You say the mortgage is in joint names, I assume your name is also on the title deeds. If this is not the case you do need to take urgent advice and protect your interest in case your partner attempts to sell the property from under you.

If your name is on the title deeds he will not be able to do this. If you agree on the terms of your separation, then you will need a solicitor to deal with the property, either the sale or a transfer to one of you , if one decides to buy the other out, other than that you should not need any additional help.
