Separated from husband: can he claim against an inheritance I am about to receive?

by Conrad Murray last modified 2007-03-26 14:23

After 2 years separation from my husband and with my mother about to die - does my ex-husband-to-be get a claim on my inheritance when we divorce?

It is not quite as simple as your estranged husband being able to make a claim against your inheritance if one of you starts divorce proceedings, however, if your inheritance is imminent which it seems to be form your e-mail, then the inheritance can be taken into consideration when looking at the assets available.

If the inheritance is a recourse available to you it is likely to have an  impact upon your needs.  I cannot emphasise enough the importance of seeking detailed legal advice, general advice is very difficult as each case turns on its own individual facts. Once all the facts are known then an opinion can be given about your particular situation.

If I can be of any further assistance please let me know.
